Tell Congress: Title 42 Must End

The good news: The Biden administration has announced the end of a horrible, dangerous, immoral Trump-era policy called Title 42, which, for over two years, was used to block migrants from seeking asylum at the U.S. southern border under the guise of protecting public health. Title 42 has resulted in approximately 1.7 million expulsions of asylum seekers back to harm, which has disproportionately impacted Black migrants, and dramatically infringed on the human right to seek asylum.

The problem: This is a welcome announcement, but Title 42’s supporters aren’t happy. The anti-immigrant contingent is already attacking the Biden administration for the decision. Bipartisan bills have been introduced in the House and the Senate that would block the Biden administration from repealing the law. There are many Members of Congress on the fence - they need to hear from us now.

I write as a supporter of T’ruah: The Rabbinic Call for Human Rights and a member of the faith-rooted community committed to seeing the immediate end of Title 42. I believe Title 42 is a cruel and inhumane policy creating chaos and harming thousands of people fleeing persecution. I’m heartened that the Biden Administration wants to end Title 42 and has a plan to restore access to asylum to those who seek it while also managing migration at the border. I am asking your office to oppose any efforts that will block asylum access at the border, be they standalone legislation, amendments to the COVID-19 relief bill or any other actions. DHS has tools to manage an uptick in migration- it’s not necessary to keep Title 42 in place. Title 42 puts Ukrainians, Afghans, Venezuelans, Cubans and others at risk. Title 42 fuels violence and chaos at the southern border. From the very first day of Title 42’s implementation, public health experts have said it was not a useful tool to prevent the spread of COVID-19, the stated intent of the policy. It’s absolutely time for this policy to end. Thank you so much for your efforts on this issue.
